TERMS AND CONDITIONS


These Terms and Conditions ("Terms") govern your access to and use of www.fairfinancialcare.com and any other website operated by Fairfincare LLC that links to these Terms (collectively, the "Website").

The Website is owned and operated by Fairfincare LLC ("Fairfincare," "FFC," "we," "us," or "our"), a Delaware limited liability company.

By accessing or using the Website, submitting information through the Website, or otherwise interacting with FFC through the Website, you agree to these Terms and our Privacy Policy.

These Terms contain an arbitration agreement and class-action waiver that affect your legal rights. Please review Section 15 carefully.

1. ELIGIBILITY

The Website is intended for individuals who are at least 18 years of age and located in the United States.

By using the Website or submitting information to FFC, you represent that you are at least 18 years old and legally capable of entering into these Terms.

2. ABOUT FAIRFINCARE

Fairfincare LLC is a marketing, referral, and consumer-assistance company. Fairfincare is not itself the provider or servicer of the financial products or services presented through the Website.

FFC maintains relationships with independent third-party financial service providers ("Network Partners") and helps consumers identify and connect with providers and programs that may be relevant to their stated financial needs.

Depending on the product, service, and Network Partner, FFC may:

  • collect information concerning your financial circumstances and objectives;
  • conduct an initial consultation or budget analysis;
  • help you understand and compare available financial options;
  • conduct preliminary qualification or eligibility screening based on criteria supplied by Network Partners;
  • explain information regarding a Network Partner's products, services, pricing, eligibility requirements, and program features;
  • assist with applications, forms, documentation, enrollment, or onboarding processes; and
  • connect, refer, or transfer you to a Network Partner that may provide or service the applicable product or service.

FFC's assistance with qualification, documentation, application, enrollment, or onboarding does not mean that FFC is the provider or servicer of the underlying financial product or service.

Unless expressly disclosed otherwise in connection with a particular offering, the applicable Network Partner is responsible for approving, providing, administering, performing, and/or servicing the financial product or service.

3. FINANCIAL PRODUCTS AND SERVICES

The Website may provide information or assistance concerning financial products and services that include, among others:

  • debt settlement and other unsecured debt solutions;
  • debt management;
  • debt consolidation;
  • personal loans;
  • mortgage refinancing;
  • tax-related assistance;
  • credit-related services;
  • bankruptcy alternatives; and
  • other consumer financial products or services.

Not every product or service is available in every state or to every consumer.

Products and services offered by Network Partners are subject to their own eligibility requirements, underwriting criteria, fees, terms, conditions, disclosures, agreements, and applicable laws.

FFC does not guarantee that you will qualify for or be accepted into any particular product, service, loan, program, or financial solution.

4. FFC IS NOT THE UNDERLYING SERVICE PROVIDER

Unless expressly stated otherwise for a particular product or service, FFC is not a bank, lender, creditor, loan servicer, debt settlement service provider, debt management company, credit counseling agency, mortgage lender, mortgage servicer, tax resolution firm, accounting firm, law firm, or credit repair organization.

FFC does not itself fund loans, extend credit, settle debts, negotiate debts with creditors, service debt settlement programs, provide legal representation, prepare tax returns, represent consumers before taxing authorities, or provide other regulated professional services merely because information concerning such services appears on the Website.

Those services, when applicable, are provided by independent third-party Network Partners.

FFC does not provide legal, tax, accounting, investment, or other professional advice. Information provided by FFC or appearing on the Website is for general informational and marketing purposes and should not be treated as a substitute for advice from an appropriately licensed professional.

5. NETWORK PARTNERS

Network Partners are independent third parties and are not employees or agents of FFC merely because they receive referrals, applications, enrollments, or consumer information from FFC.

A Network Partner may have additional agreements, disclosures, authorizations, privacy policies, and terms that apply to the products or services it provides.

Before accepting or enrolling in a product or service, you should carefully review the Network Partner's applicable disclosures and agreement.

FFC does not control the subsequent performance of independent Network Partners and cannot guarantee their actions, decisions, results, processing times, servicing practices, or continued availability.

Nothing on the Website should be interpreted as a guarantee or warranty regarding a Network Partner or a particular financial outcome.

6. COMMUNICATIONS AND CONSENT TO CONTACT

When you provide your telephone number, email address, or other contact information to FFC, you authorize FFC to contact you regarding your inquiry, requested consultation, products or services in which you have expressed interest, and related communications, subject to applicable law and any specific consent presented to you when your information is collected.

Where you separately provide consent to receive automated or recurring communications, such communications may include calls or text messages made using automated technology as described in the applicable consent disclosure.

Message and data rates may apply. Message frequency may vary.

You may opt out of recurring text messages by replying STOP. You may also contact FFC regarding your communication preferences.

Consent to receive marketing calls or text messages is not a condition of purchasing any product or service.

Where a particular type of communication requires additional consent under applicable law, the specific consent language presented at the time your information is collected will govern that communication.

7. INFORMATION YOU PROVIDE

You agree that information you provide to FFC will be accurate and complete to the best of your knowledge.

FFC may use information you provide to:

  • respond to your inquiry;
  • conduct preliminary qualification or eligibility analysis;
  • identify potentially relevant products, services, or Network Partners;
  • assist with applications, documentation, enrollment, or onboarding;
  • communicate with you;
  • connect you with appropriate Network Partners;
  • prevent fraud or misuse;
  • comply with applicable legal and regulatory obligations; and
  • operate and improve our business and Website.

Our collection, use, retention, disclosure, and protection of personal information is governed by our Privacy Policy and any additional privacy disclosures or authorizations presented when information is collected.

Submitting personal information to FFC does not transfer ownership of your personal information to FFC.

8. SHARING INFORMATION WITH NETWORK PARTNERS

You understand that FFC may need to share information you provide with one or more Network Partners in order to determine potential eligibility, obtain information regarding available options, assist with an application or enrollment, or connect you with a provider.

The Network Partner may separately request your consent or authorization before providing or servicing a product.

FFC's Privacy Policy provides additional information regarding how personal information may be collected, used, and disclosed.

9. COMPENSATION DISCLOSURE

FFC is an advertising-supported and referral-based business and may receive compensation from Network Partners.

FFC may receive compensation when, for example, a consumer is referred to, transferred to, applies with, enrolls with, obtains a product or service from, or otherwise becomes a customer of a Network Partner.

The existence or amount of such compensation may vary among Network Partners.

FFC does not represent that the Website contains, compares, or considers every financial institution, service provider, product, program, or financial option available in the marketplace.

Consumers should independently evaluate whether any product or service is appropriate for their individual circumstances.

10. NO GUARANTEE OF RESULTS

FFC does not guarantee:

  • approval for any loan or financial product;
  • any particular interest rate, loan amount, repayment term, or monthly payment;
  • acceptance into any debt-relief or financial program;
  • any specific reduction in debt;
  • that any creditor will agree to settle or modify a debt;
  • any particular tax result;
  • improvement in a credit score;
  • improvement in a consumer's overall financial condition;
  • savings of any particular amount;
  • completion of a program within any particular period; or
  • any other specific financial result.

Examples, calculators, illustrations, estimates, or educational information appearing on the Website are for informational purposes only and do not constitute a guarantee of actual results.

Your results will depend upon your individual circumstances, the applicable Network Partner, creditor or lender decisions, program requirements, market conditions, and other factors outside FFC's control.

11. PERMITTED USE OF THE WEBSITE

FFC grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Website for lawful personal purposes.

You agree not to:

  • use the Website for unlawful, fraudulent, abusive, or deceptive purposes;
  • provide false or misleading information;
  • impersonate another individual or organization;
  • attempt to gain unauthorized access to the Website or related systems;
  • interfere with the operation or security of the Website;
  • introduce viruses, malware, or other harmful technology;
  • use automated scraping, crawling, or data-extraction technology without FFC's written permission;
  • copy, reproduce, distribute, sell, or commercially exploit Website content without authorization; or
  • violate the intellectual property, privacy, or other rights of FFC or another person.

FFC may restrict or terminate access to the Website where it reasonably believes these Terms have been violated.

12. INTELLECTUAL PROPERTY

The Website and its content, including text, graphics, logos, designs, software, photographs, videos, and other materials, are owned by or licensed to FFC and are protected by applicable intellectual-property laws.

Nothing in these Terms transfers ownership of FFC's intellectual property to you.

You may use Website content solely for personal, non-commercial purposes unless FFC provides prior written authorization for another use.

13. THIRD-PARTY WEBSITES

The Website may contain links to websites operated by Network Partners or other independent third parties.

FFC does not control third-party websites and is not responsible for their content, security, availability, privacy practices, terms, or activities.

Your use of a third-party website is governed by that third party's terms and privacy policies.

A link from the Website does not by itself constitute an endorsement or guarantee by FFC of every statement, product, or service appearing on the third-party website.

14. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

FFC DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

FFC DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FFC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Nothing in this Section is intended to eliminate rights or remedies that applicable consumer-protection law does not permit a consumer to waive.

15. DISPUTE RESOLUTION AND ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED IN COURT OR BY A JURY AND YOUR ABILITY TO PARTICIPATE IN A CLASS ACTION.

15.1 Informal Resolution

Before commencing arbitration, you and FFC agree to make a reasonable good-faith effort to resolve the dispute informally.

A written notice of dispute should describe the nature of the dispute, relevant facts, and requested relief and should be sent to:

The parties will have 30 days after receipt of the notice to attempt to resolve the dispute before commencing arbitration, unless applicable law requires otherwise.

15.2 Agreement to Arbitrate

Except for disputes that qualify for small-claims court and requests for temporary or preliminary injunctive relief where permitted by law, you and FFC agree that disputes arising out of or relating to these Terms, the Website, or your interactions with FFC will be resolved through binding individual arbitration rather than in court, to the extent permitted by applicable law.

The arbitration will be administered by the American Arbitration Association ("AAA") pursuant to the applicable AAA Consumer Arbitration Rules in effect when the arbitration is commenced.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

15.3 Small Claims

Either party may bring an individual claim in a small-claims court of competent jurisdiction where the claim qualifies for that court.

15.4 Class-Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FFC AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim, except where applicable law requires otherwise.

15.5 Arbitration Costs and Procedures

Arbitration fees and costs will be allocated in accordance with the applicable AAA Consumer Arbitration Rules and applicable law.

If any portion of this arbitration provision is determined to be unenforceable, the remaining portions will remain effective to the fullest extent permitted by law, unless the unenforceable provision cannot be severed without materially altering the agreement to arbitrate.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except to the extent federal law applies or the law of a consumer's state of residence provides rights that cannot lawfully be waived.

For disputes that are not subject to arbitration, the parties consent to the jurisdiction of courts having lawful jurisdiction in Delaware, except where applicable law requires another jurisdiction or venue.

17. CHANGES TO THESE TERMS

FFC may modify these Terms from time to time.

When material changes are made, FFC will update the "Last Updated" date above and provide any additional notice required by applicable law.

Changes will apply prospectively from their effective date.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

18. TERMINATION

FFC may suspend, restrict, or discontinue the Website or your access to it where reasonably necessary for security, legal, operational, fraud-prevention, or other legitimate business reasons.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, dispute resolution, and governing law, will survive termination.

19. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate, and the remaining provisions will remain in effect.

20. NO WAIVER

FFC's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

21. ASSIGNMENT

You may not assign your rights or obligations under these Terms without FFC's prior written consent.

FFC may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or other lawful transfer of its business or interests, subject to applicable law.

22. ENTIRE AGREEMENT

These Terms and the Privacy Policy constitute the agreement between you and FFC concerning your use of the Website.

If you subsequently enter into an agreement directly with a Network Partner, that separate agreement governs the product or service provided by that Network Partner.
